First of all, if you're looking at the patent system, copyright
(and note the spelling) doesn't apply.
Second of all, you CAN copyright software -- i.e. programming code.
That's why games, utilities, etc all have copyright notices, with
the exception of some open source software and/or freeware, but
even many of these have usage restrictions that define how and when
it can be copied.
Third, certain software concepts CAN be patented. Many believe the
system has gone to far, but still, the US Patent & Trademark Office
HAS allowed software patents.
